2. The petitioner is apprehending his arrest in connection with Surajgarha P. S. Case No. 144 of 2022 registered on 09.05.2022 for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

3. According to the prosecution, F.I.R. has been lodged against two named accused persons. Total recovery of 30 litre country made liquor has been made, which is the subject matter of the present case.

4. Learned counsel for the petitioner submits that neither petitioner has been apprehended from the place of occurrence nor anything found from his possession. Counsel further submits that the name of the petitioner has figured in this

Patna High Court CR. MISC. No.54814 of 2023(2) dt.23-08-2023 2/2 case by virtue of secret information provided to the police. Counsel further submits that antecedent of the petitioner is clean and alleged recovery has been made from Dhanauri Chandanpura canal road, which is said to be public place.

5. Learned APP for the State submits that there is allegation against the petitioner but he also submits that antecedent of the petitioner is clean.

6. Considering the aforesaid facts and circumstances of this case, let the above-named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within 6 weeks from today, on furnishing bail bond of Rs. 30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-IV-cum-Special Excise Judge-I, Lakhisarai in connection with Surajgarha P.S. Case No. 144 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
