JUSTICE RAVI RANJAN ORAL ORDER 05-09-2016 Heard learned counsel for the petitioner and the State. The Petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 448, 341, 323, 504, 506, 354, 379 and 34 of the Indian Penal Code.

It is submitted on behalf of the petitioner that the petitioner and the informant's side are agnates and there was dispute with regard to fetch drinking water from Hand Pump and for that reason, the petitioner has been falsely implicated in this case. It is further contended that the injuries upon Bangali Bind are superficial in nature and have been categorized as simple. The petitioner claims that his antecedent is clean. No.31721 of 2016 (2) dt.05-09-2016 2/2 case, let the above named petitioner be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Halsi P.S. Case No.47 of 2016 on furnishing bail bonds of Rs.10,000/- (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sri Rajendra Das, Judicial Magistrate, 1st Class, Lakhisarai, subject to the conditions laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.

However, at the time of accepting bail bond, the court below will verify and assure itself regarding the criminal antecedent of the petitioner. If the petitioner is having clean antecedent then his bail bond would be accepted otherwise he would be taken into custody.
