The petitioner seeks regular bail in connection with Araria PS case no. 526 of 2018 registered for the offence punishable under Section 414/34 of Indian Penal Code. The allegation is regarding recovery of a motorcycle said to have been stolen one from the possession of the petitioner and the co-accused persons when they were fleeing away, upon a checking being conducted by the police. The learned counsel for the petitioner submits that till date, the police has not been able to show that the motorcycle was a stolen one and further, the motorcycle was not recovered from the possession of the petitioner. Lastly, it is submitted that the petitioner is having a clean antecedent and he is languishing

Patna High Court Cr.Misc. No.72391 of 2018(2) dt.13-12-2018 2/2 in custody since 10.08.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Araria PS case no. 526 of 2018.
