JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2018 The petitioner seeks regular bail in connection with Athmalgola P.S. Case No. 85 of 2018, registered for offences punishable under Sections 147, 148, 149, 341, 323, 324, 504, 307, 379 of the Indian Penal Code.

Allegation against the petitioner and several other accused persons that they chased the informant and assaulted him and when sons of the informant came to save him, they were also assaulted. Son of the informant Sonu Kumar had died during course of treatment and further added 302 of the Indian Penal Code.

Submission of learned counsel for the petitioner is that several accused persons have been named in the F.I.R. and no specific allegation has been attributed against the petitioner and the postmortem report also shows that as a matter of fact

Patna High Court Cr.Misc. No.71655 of 2018(3) dt.21-12-2018 2/2 there is only one injury was found on the body of the deceased and the petitioner is in judicial custody since 10.05.2018. Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for bail of the petitioner.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge, at Barh, District Patna, in connection with Athmalgola P.S. Case No. 85 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
