The petitioner has preferred this application for grant of regular bail in a case registered against seven unknown under section 395 of the Indian Penal Code.

As per allegation in the FIR, seven accused persons on different motorcycles looted various articles from the ornament's shop of the informant. The informant claims that he can identify the accused on seeing them again. It is submitted by learned counsel for the petitioner that the name of the petitioner transpired in the confessional statement of coaccused Deepak Kumar. Thereafter he was arrested in one another case and remanded in the instant case on

Patna High Court CR. MISC. No.10069 of 2021(3) dt.29-07-2021 2/2 28.1.2020. However, chargesheet has been submitted without conducting any T.I. Parade and no incriminating article has been recovered from his possession.

The application for bail is opposed by learned Additional Public Prosecutor for the State.

Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody for 1 year 5 months and chargesheet having been submitted in this case without conducting T.I parade of the petitioner, the Court directs the petitioner to be enlarged on bail in connection with Garoul Kathara (O.P) P.S. Case no. 161 of 2019 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Vaishali at Hajipur.
