The petitioner apprehends his arrest in connection with Dhanaha P.S. Case No. 103 of 2015 for the offences registered under Sections 409, 420/34 of the Indian Penal Code.

Learned Senior counsel for the petitioner submits that co-acussed namely, Krishan Datt Ram @ Sri Krishan Datt Ram, who was the Panchayat Secretary of Dumri Gram Panchayat has been extended the privilege of anticipatory bail in

connection with the present case. The said order was passed in view of the fact that the substantial portion of the work had been completed during his tenure as Panchayat Secretary and the rest portion of the work was undertaken to have been completed shortly, thereafter. It is further submitted that in the case diary it has come on record that about 80 per cent of the work was, in fact, completed during the tenure of the said petitioner and as such, the benefit of pre-arrest bail was extended to him. The present petitioner being the similarly situated accused persons may also be extended the same privilege.

Having heard learned counsel for the parties and after consideration all the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of

the like amount each to the satisfaction of A.C.J.M., Bagaha, West Champaran, in connection with Dhanaha P.S. Case No. 103 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
