The petitioner is accused in connection with Giriyak P.S. Case No. 299 of 2018 registered under Sections 341, 323, 324, 307 and 506/34 of the Indian Penal Code and Section 3⁄4 of the Explosive Substance Act.

The accusation is that, at about 8 P.M., informant, Bhushan Kumar Yadav, along with Surendra Kumar and Pappu Kumar proceeded to Giriyak from his brick kiln. In the way, bomb was exploded on them, in which, they sustained injury. The informant claimed that he saw in the light of motorcycle that petitioner, his brother Nirmali Yadav and one unknown, who was not identified due to darkness, fled away from there. Informant further claimed that on the same day, in the morning, at about 8 A.M., petitioner and Nirmali Yadav came at the brick kiln and giving threatening to Surendra Kumar to leave the company of the informant. Learned counsel for the petitioner submits that it would appear from the F.I.R. that neither the informant nor his two associates who are said to be sustained bomb blast injury, had not seen the petitioner hurling bomb. Mere on suspicion, petitioner and his brother have facilely been implicated in this case due to enmity. It is further submitted that petitioner has no criminal antecedent and is in custody since 20.08.2018.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Biharsharif, Nalanda, in connection with Giriyak P.S. Case No. 299 of 2018. Out of two sureties, one surety must be the close relative of the petitioner.
