JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 24-08-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Case No. 122-C2 of 2016 registered under Section 47(a) (c) of the Bihar Excise Act.

The accusation is of recovery of 10 liter country made liquor and 100 Kg. Jaba Mahua in 10 Tin recovered from the house and Bari of the petitioner.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the seizure list that at the time of recovery, petitioner was not present in her house, and she has falsely been implicated in this case. Further submission is that petitioner has no criminal antecedent.

No.33324 of 2016 (2) dt.24-08-2016 2/2 Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the J.M., 1st Class, Jamui in connection with Case No. 122-C2/2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
