====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 06-12-2018 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Excise Case No. 1476 of 2018 arising out of Sikarhatta P.S. Case No. 62 of 2018, instituted for the offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

The prosecution case briefly stated is that on 14.09.2018 at about 10:45 hours, the informant on secret information reached in Birbal Tola along with other police party and saw one Pick-up van stopped there in start condition. The driver of Pick-up van was arrested. One person managed to run away. He disclosed his name as Ashok Kumar Singh (petitioner). He also disclosed the name of person who managed to run away from the place of occurrence as Santosh

Patna High Court Cr.Misc. No.72907 of 2018(2) dt.06-12-2018 2/2 Singh. The police on search of vehicle, recovered 280 liters of foreign liquor.

Petitioner is said to be owner of the aforesaid vehicle. He was found sitting on the vehicle. He is in custody since 15.9.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge-cum-Special Judge, Excise, Bhojpur at Ara, in connection with Excise Case No. 1476 of 2018 arising out of Sikarhatta P.S. Case No. 62 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
