Mr. Abhishek Kumar Singh, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-08-2025 Heard learned counsel for the petitioners, informant and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 126(2), 115(2), 118(2), 109(1), 351(3), 352 of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.

3. As per F.I.R., on the alleged date and time of occurrence, when son of the informant went to Navranga field for exercise, all the F.I.R. named accused persons, including these petitioners along with some unknown miscreants assaulted

Patna High Court CR. MISC. No.53198 of 2025(2) dt.13-08-2025 2/3 him by means of sticks, bhala, rod, sword, sickle, iron chain and pistol as a result of which he sustained multiple injuries.

4. Learned counsel appearing for the petitioners submits that specific accusation of assault is against petitioner nos. 2 and 3. So far rest of the petitioners are concerned, there is no specific allegation of overt act against them. Petitioners claim clean antecedent.

5. Learned counsel for the State as well as learned counsel for the informant vehemently opposed the bail application and submitted that injuries attributed to petitioner nos. 2 & 3 are grievous in nature.

6. In view of the fact that petitioner nos. 2 & 3 caused grievous injury, prayer for anticipatory bail of petitioner nos. 2 & 3 is refused.

7. However, considering the nature of accusation and clean antecedent against petitioner nos. 1 & 4, the anticipatory bail with regard to petitioner nos. 1 & 4 is allowed and it is ordered that the above named petitioner nos. 1 & 4 in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief
