JUSTICE RAVI RANJAN ORAL ORDER 17-09-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.
It is contended on behalf of the petitioner that FIR was lodged against five named and 35-40 unknown persons. There is general and omnibus allegation against the petitioner, however, there is specific allegation of firing upon co-accused Ashutosh Upadhyay. There is admitted land dispute between the parties. There is a case and counter case also between the parties. Having regard to the facts and circumstances of the case, let the petitioner, namely, Rupesh Mishra be released on

No.34373 of 2016 (2) dt.17-09-2016 2/2 bail in the event of his arrest/surrender before the court below within a period of six weeks from today in connection with Turkaulia P.S. Case No.197 of 2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
