The petitioner is apprehending his arrest in connection with Vaishali P.S.Case No.138 of 2019 registered for offences punishable under Sections 30 (a), 32(2) and 41(1) of the Bihar Excise Act..

As per FIR, there is allegation of recovery of huge quantity of liquor (altogether 6201 ltrs.) . FIR also discloses active involvement of the petitioner. Apart from the above fact, from the report received from the S.P.,Vaishali at Hajipur, it appears that he is accused in one more case but he has not stated so in para 3 of his petition. As he has stated , he has no criminal antecedent.

Submission of the learned counsel for the petitioner is that the allegations are vague and co-other accused persons

Patna High Court CR. MISC. No.53249 of 2019(5) dt.27-11-2019 2/2 have been granted privilege of anticipatory bail by different Benches of this Court.

Heard learned A.P.P. , who has opposed the prayer for bail.

Having heard both sides and in view of allegations made against him as well as the fact that he has suppressed the criminal antecedent, I am not inclined to grant privilege of anticipatory bail to the petitioner.

With the aforesaid direction, this application is dismissed.
