Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Complaint case no. 298 of 2023, in which cognizance has been taken under Sections 498(A), 323, 506/34 of the Indian Penal Code.

Learned counsel for the petitioner as well as opposite party no. 2 have submitted that the matter has amicably been settled between husband and wife in mediation and Memorandum of Agreement has been executed on 02.02.2024, having terms and conditions of compromise.

Regarding being had to the submissions made on behalf of both the parties and taking into consideration the fact that both parties have entered into amicable settlement, I am inclined to grant the privilege of anticipatory bail to the petitioner, subject to the condition that petitioner shall abide by the terms of Memorandum of Agreement dated 02.02.2024. 5.
This application is, accordingly, allowed.

Let petitioner, abovenamed, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 2nd class, Begusarai in connection with complaint case no. 298 of 2023, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
