JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2018 Petitioner prays for bail in connection with Darbhanga Sadar P.S.Case No. 61 of 2018 registered for the offence punishable under Section 382 of the Indian Penal Code. Allegation as per FIR against the petitioner I that he along with others has forcibly snatched motorcycle of the informant and though petitioner is not named in the FIR but later on motorcycle has been recovered from the possession of the petitioner and for that a separate case has been lodged. Submission of learned counsel for the petitioner is that he has been made accused due to village rivalry and he is on bail in another case and in connection with this case he is in custody since 2.6.2018.

No.76398 of 2018(2) dt.21-12-2018 2/2 Having heard both sides and in the facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga, in connection with Darbhanga Sadar P.S.Case No. 61 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
