The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 353, 337, 427 of the Indian Penal Code and 47A of the Excise Act.

The prosecution case is that the informant being a Police Officer was on patrolling duty, when on information that one naxalite Karu Mandal had taken shelter in the village Dharara, raid was laid in the house of Raghunath Sao leading to recovery of huge quantity of country made liquor, while making seizure of the articles, the mob attempted to confine the informant and started pelting stones, as a result police personnel received injury and police vehicle also got damaged.

Patna High Court Cr.Misc. No.38997 of 2015 (2) dt.01-10-2015 It is submitted by the learned counsel for the petitioner that the accusation against mob and not against the petitioner. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sri N.P. Singh, Judicial Magistrate, Ist Class, Sherghati, Gaya in connection with Barachatti (Mohanpur) P.S. Case No. 218 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
