ANJANA MISHRA ORAL ORDER 12-08-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Sitamarhi S.C./S.T. P.S. Case No.78 of 2015 for allegedly having committed the offence under Sections 341, 323, 379, 504/34 of the Indian Penal Code and Section 3(i)(x)(xi) of the S.C./S.T. Act.

It appears that there is an allegation against the petitioners of attacking the informant with slaps and lathis and having snatched the silver locket and gold earring belonging to the wife of the informant. Learned counsel for the petitioners submits that it is nothing but a case of political vendetta and

Considering the entire facts and circumstances of the case and that the petitioners have no criminal antecedents, let both the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi, in connection with Sitamarhi S.C./S.T. P.S. Case No.78 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
