Petitioner, namely, Mithilesh Kumar @ Mithilesh Pandey apprehends his arrest in Gopalganj (Town) P.S. Case No.272 of 2016 (G.R. No.1876 of 2016) under Sections 420, 409, 34 I.P.C.

According to the prosecution case, when audit was made in the godown of the petitioner on 18.03.2016, 10118 cases and 531 bottles of foreign liquor and beer were found less value of which is Rs.1,46,83,287.90.

Learned counsel for the petitioner submitted that this audit was made on 18.03.2016 whereas the petitioner had already been transferred from godown in question on 27.02.2016, which would be evident from the report itself, which is a part of F.I.R.

Patna High Court Cr.Misc. No.40664 of 2016 (3) dt.05-10-2016 From perusal of this report, it appears that petitioner, Mithilesh Kumar was found to have worked as Godown Manager till 28.02.2016 only. The audit was done on 18.03.2016. Considering the above facts and circumstances of the case I direct the petitioner named above to surrender before the court below within one month from today and on his so surrendering it is directed that the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj (Town) P.S. Case No.272 of 2016.
