The petitioner seeks regular bail in connection with Kotwali P.S.Case No.429 of 2018 dated 10.9.2018 G.R.No.6200 of 2018 registered for offences punishable under Sections 457 of 380 of the Indian Penal Code.
Allegation against the petitioner as per FIR is that some accused persons were committing theft in the house of the informant but in the meantime the informant was there as such he started fleeing and one of the witnesses has named this petitioner.
Submission of the learned counsel for the petitioner is that even according to the FIR no theft was committed and the petitioner is in custody since 12.9.2018.
Patna High Court Cr.Misc. No.71542 of 2018(2) dt.10-12-2018 2/2 Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Gaya in connection with Kotwali P.S.Case NO.429 of 2018 (G.R.No.6200 of 2018). With the aforesaid observation, this application is allowed.
