The petitioner is languishing in custody for the offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
According to the FIR co-accused Md. Sagir and Md. Sakil along with unknown are suspected to have committed murder the son of the informant. Petitioner is not named in the FIR, however, subsequently, the petitioner was arrested along with fire-arm for which a separate case was lodged vide K. Hat (Madhubani) P.S. Case No. 187 of 2019 and in that case confessional statement of petitioner was recorded by the police wherein, the petitioner admitted involvement of the murder. Submission is that there is no other material save and
Patna High Court CR. MISC. No. 48958 of 2019(2) dt.06-08-2019 2/2 except confessional statement before police while he was in custody. Petitioner is in custody since 17.05.2019. Considering the aforesaid fact, let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with K.Hat (Madhubani) P.S. Case No. 186 of 2019, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court below having immovable property in his name.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) khushbu/- U T
