2. However, learned counsel for the State as well as learned counsel for the O.P. No.2 are present.

3. The present Criminal Miscellaneous Petition has been filed for quashing of FIR bearing Madhubani P.S. Case No.145 of 2022, registered for the offences punishable under Sections 420, 406, 468 and 120B of the Indian Penal Code.

4. However, learned counsel for the O.P. No.2 refers

No.57174 of 2023(19) dt.04-12-2025 2/2 to paragraph no. 2 of the Criminal Miscellaneous Petition, which shows that previously the Petitioner has preferred one Criminal Miscellaneous Case No. 42048 of 2022 before this Court for quashing the same subject FIR bearing Madhubani Town P.S. Case No. 145 of 2022.

5. However, the said Criminal Miscellaneous Case No. 42048 of 2022 was withdrawn by the Petitioner vide order dated 17.11.2022, after some arguments, getting liberty to file an appropriate application seeking quashing of cognizance order, if passed by learned Court below.

6. In view of such averment made in the petition, the present petition is dismissed as not maintainable because by this petition, again the Petitioner is seeking quashing of the same subject FIR.

7. Accordingly, the present petition is dismissed as not maintainable.
