JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 26-07-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Salkhua P. S. Case No.255 of 2015 registered under Sections 147, 148, 149, 341, 323, 379, 385, 307 and 506 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the specific allegation in the FIR has been made against co-accused Ashok Yadav, Amarendra Yadav and Rudal Yadav. So far as the petitioner is concerned, there is absolutely no allegation of any overtact against him.

Learned counsel for the State does not controvert the

Regard being had to the submissions advanced at the Bar, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Saharsa in Salkhua P. S. Case No.255 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
