JUSTICE PARTHA SARTHY ORAL ORDER 09-07-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Paroo P.S. Case No. 156 of 2020 registered against unknown under section 395 of the Indian Penal Code.

As per allegation in the F.I.R., six accused persons looted a sum of Rs.2.53 lacs (approx) from the bank. It is stated by the informant that he can identify the accused on seeing them again.

It is submitted by learned counsel for the petitioner that the name of the petitioner transpired in the confessional statement of a co-accused made before police and the petitioner

Patna High Court CR. MISC. No.9872 of 2021(3) dt.09-07-2021 2/2 was remanded in this case on 11.9.2020. No incriminating article has been recovered from his possession and he has not been put on T.I. parade.

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the fact that inspite of being in custody for more than nine months, the petitioner has not been put on T.I. parade and investigation in the case has concluded, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Paroo P.S. Case No. 156 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate (West), Muzaffarpur.
