JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-05-2023 The present writ petition has been filed seeking the following relief :- " (i) For issuance of a writ in the nature of 'Certiorari' for setting aside the order dated 31.03.2022 passed by learned Additional Collector, Darbhanga in Encroachment Appeal Case No. 69/2019- 20, by which, he has affirmed the order 09.11.2019, passed by the Circle Officer in Encroachment Case No.

3/2019-20 with regard to the lands appertaining to Khata No. 1785 (New-

Patna High Court CWJC No.13886 of 2022(2) dt.09-05-2023 2/2 disputed), bearing Khesra No. 6490, measuring an area of 16 Decimal, falling within Mauza Sanahpur Bujurg, Thana No.

51, Block -- Singhwada, District - Darbhanga, by which, the Circle Officer Singhwada has been directed to get the aforesaid residential land vacated forthwith. And further prayer of the aforesaid petitioner is to command and direct the state respondents hereinabove not to disturb the physical possession of the petitioner, who is living over the aforesaid land with his family members for 20 years back by constructing a pucca building over there."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies, as are otherwise available under the law. Liberty so sought, is granted.
