JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-01-2019 The petitioners apprehend their arrest in connection with Bihta P.S.Case No. 758 of 2018 registered under Sections 323, 341, 427 and 504/34 of the Indian penal Code and 27 of the Arms Act.
Allegation as per the FIR is that in a Barat Party due to explosion of crackers, daughter of petitioner no. 1 sustained injuries due to which petitioners and Chandan Mochi prohibited Barat Party to go through that way and also abused the Barat Party and further allegation is that on 11.07.2018 at about 1:00 P.M., while the informant and Sunil Kumar were passing through the house of petitioner no. 1, they were abused and Chandan Mochi and Sanjivan Mochi assaulted the informant by Farsa causing injury on his head and finger and there is further
Patna High Court Cr.Misc. No.78164 of 2018(2) dt.07-01-2019 2/2 allegation that Chandan Mochi thereafter made indiscriminate firing.
Submission of learned counsel for the petitioners is that there is case and counter case in between the parties and dispute arose with respect to passing of Barat Party and now they have compromised the case.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-I, Danapur (Patna) in connection with Bihta P.S. Case No. 758 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
Accordingly, this application is allowed.
