====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 04-01-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Learned counsel for the petitioner submits that the petitioner is in custody since 27.09.2021 and has antecedent of five cases and as per allegation in the FIR, it is alleged that the petitioner is one of the assailant of the deceased along with two other accused.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that it absolutely does not stand to reason that when so many accused are alleged of being committing the occurrence, then how it was possible for the informant to identify as to who assaulted or fired on his nephew.

Patna High Court CR. MISC. No.53993 of 2022(2) dt.04-01-2023 2/2 Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner and submits that there is a direct allegation against this petitioner also of firing at the nephew of the deceased and informant is an eye-witness to the occurrence. Considering the submissions made by the learned A.P.P. for the State, the Court is not inclined to release the petitioner on bail.
