The petitioner seeks bail in Daniawan Police Station Case No 89 of 2018 registered under Sections 341, 323, 498A of Indian Penal Code and Sections 3⁄4 of Dowry Prohibition Act. Petitioner is the husband of the informant. The informant alleged that after her marriage on 06.12.2017 with Rakesh Choudhary, the petitioner, she went to her Sasural but her husband and others began to assault her. She further disclosed that on 25.07.2018, she was assaulted and was driven out from the house.
Learned counsel for the petitioner submits that no occurrence, as alleged by the informant, has taken place. The informant herself does not want to live with the petitioner and
Patna High Court Cr.Misc. No.72264 of 2018(2) dt.11-12-2018 2/2 the petitioner is in jail since 03.09.2018. Petitioner has already remained in jail for more than three months.
Considering the aforesaid facts and nature of allegation against the petitioner, being husband of informant as also the fact that the petitioner has already remained in jail for more than three months, the petitioner above named is directed to be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Patna City in Daniawan Police Station Case No 89 of 2018 dated 25.07.2018.
