2. The petitioner has preferred this application for grant of regular bail in connection with Bakhri P.S. Case No. 358 of 2024 dated 16.09.2024 registered for the offences punishable u/ss115(2), 118(1), 352, 351(2), 308(5) read with Section 3(5) of the B.N.S.

3. As per the prosecution case, on 16.09.2024, when the informant was sitting at Durga Mandir near Bakhri Makkhachak, in the meantime, the petitioner and the coaccused, Rohit Kumar started assaulting him with fist, slap and butt of pistol. The co-accused, Rahul Kumar assaulted him with knife causing injuries on his hand. It is further alleged that the

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner and the informant are the co-villagers and due to previous enmity, the petitioner has been made accused in this case. There is case and counter case between the parties. There is no specific allegation against the petitioner rather the allegation against the petitioner is general and omnibus in nature. Nothing has been recovered from the conscious possession of the petitioner. It is further submitted that the petitioner has not demanded any extortion money from the informant. The petitioner has nine criminal antecedents in which he is on bail in five cases as stated in para 3 of the bail petition. The petitioner is in custody since 22.04.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court

Case No. 358 of 2024 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
