JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 47(a) of the Excise Act. The prosecution case is that recovery of 2400 liters of country made liquor from the premises of the petitioner has been made.

It is submitted by the learned counsel for the petitioner that the recovery has actually not been made from the premises of the petitioner rather the recovery has been made from the area adjacent to the road and only on suspicion, since the petitioner is accused in one other case, has been roped in the present case. Let the learned court below consider the prayer for

Patna High Court Cr.Misc. No.38084 of 2015 (2) dt.22-09-2015 2/2 regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Excise Case No. 76 of 2014 pending in the court of learned C.J.M. East Champaran, Motihari.
