JUSTICE RAVI RANJAN ORAL ORDER 10-08-2016 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

It is contended that though there is allegation against the petitioners that they also came armed with weapons alongwith coaccused Congress Sah but the specific allegation of assault, due to which the father of the informant died, is upon co-accused Congress Sah and the petitioners were allegedly only members of mob. It is claimed that the antecedents of the petitioners are clean. Having regard to the facts and circumstances of the case, let the petitioners, namely, Nand Kumar @ Nand Kumar

Patna High Court Cr.Misc. No.31253 of 2016 (2) dt.10-08-2016 2/2 Sah and Lal Babu Sah be released on bail in the event of their arrest/surrender before the court below within a period of six weeks from today in connection with Marhowrah P.S. Case No.264 of 2016, on furnishing bail bonds of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Chapra, District- Saran, subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
