JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-08-2015 Heard learned counsels for the petitioner and the State. Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 409,420,120B/34 of the Indian penal Code.

It is alleged that during the financial year 2008-09 to 2012-13 the petitioner being Panchayat Secretary, Jhauva Belwania Panchayat in collusion with Panchayat Mukhiya purchased solar light from the government fund allocated for 13 and 14 BRJF projects from the agencies not authorized by the government.

It is submitted by the learned counsel for the petitioner that the purchase was made after approval of the Aam Sabha and from the authorized dealer. There is no accusation that petitioner used the fund for own purpose and similarly situated persons have

Considering the aforementioned facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ara, Bhojpur in connection with Shahpur P.S. Case No. 287 of 2014 subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Prakash/- U T
