JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-12-2018 The petitioner seeks regular bail in connection with Special Case No. 9715 of 2018 arising out of Khajekalan P.S. Case No. 372 of 2018, registered for offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 36 litres of liquor from the possession of the petitioner.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and in fact nothing has been recovered either from the petitioner or from his house. Further he has no criminal antecedent and has been in judicial custody since 13.10.2018.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and

No.71826 of 2018(2) dt.07-12-2018 2/2 circumstances of the case, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 9715 of 2018 arising out of Khajekalan P.S. Case No. 372 of 2018.
