The petitioner apprehends his arrest in connection with Bakhtiyarpur P.S. Case No.210 of 2015 registered under Sections 420 and 406/34 of the Indian Penal Code besides Section 138 of the N.I. Act.

The accusation is that the co-accused Ajeet Kumar alias Ajeet Kumar Lal and this petitioner approached the informant at his house for supply of machine for preparing the plastic pipe and, accordingly, took Rs.3,32,000/- from the informant but the machine was not supplied to the informant. When the informant approached the petitioner and the co-accused Ajeet Kumar alias

Patna High Court Cr.Misc. No.35155 of 2016 (3) dt.20-10-2016 2/2 Ajeet Kumar Lal, then cheque of Rs.2,65,000/- was issued in the name of the informant but the same was dishonoured due to nonavailability of sufficient money in the account. Learned counsel appearing on behalf of the petitioner submits that the petitioner being the associate of the co-accused Ajeet Kumar alias Ajeet Kumar Lal has falsely been implicated in this case. In fact, the cheque of Rs.2,65,000/- in the name of the informant, which is said to be dishonoured, was issued by the coaccused Ajeet Kumar alias Ajeet Kumar Lal, which would appear from paragraph-4 of the case diary.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Barh, Patna, in connection with Bakhtiyarpur P.S. Case No.210 of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
