JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-08-2016 Heard learned counsel for the petitioners and the learned A.P.P for the State.
The petitioners apprehend their arrest in connection with Sabour P.S. Case No. 29 of 2016 under Sections 363 and 366A of the Indian Penal Code.
The allegation of the informant is that on 13.02.2016, in the evening his daughter aged about 14 years had gone to attend natural call but did not return. On search no trace of his daughter was found the informant went to the house of Babulal Sharma @Ranjan Sharma who was not at the house. On knowing of missing of daughter of informant Vijay Sharma
Patna High Court Cr.Misc. No.32183 of 2016 (3) dt.20-08-2016 father of Babu Lal Sharma became furious and abused him. After that Sarban Sharma, Kunda Sharma, Amrit Sharma and wife of Vijay Sharma came with lathi and danda asked him to go giving threatening. Learned counsel appearing on behalf of the petitioners submits that Petitioner no. 1 is the father of Babu Lal whereas Petitioner nos. 2 and 3 are brother and 5 is mother. From the statement recorded under Section 164 Cr.P.C it appears that she left the house due to misbehavior of her mother, aunty(Mousi) and grant mother (Nani).
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bhagalpur in connection with Sabour P.S. Case No. 29 of 2016 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
