====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 28-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Special Case No. 8488 of 2018 arising out of Khiri More P.S. Case No. 81 of 2018 instituted for the offence under Section 2(v), 3, 4 of Bihar Mahua Phool Act, 2006 and Section 3(D) of Bihar Prohibition of Liquor and Excise Act, 2016.

It is alleged in the written report that total 1650 Kg. of Mahua flower has been recovered from pick-uip van. Petitioner is said to be owner of the aforesaid van. Counsel for the petitioner submits that petitioner is in custody since 14.9.2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the

No.69075 of 2018(2) dt.28-11-2018 2/2 petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Special Case No. 8488 of 2018 arising out of Khiri More P.S. Case No. 81 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
