The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 341, 323, 337 of the Indian Penal Code and 27 of the Arms Act.

The accusation against the petitioner along with co-accused is of assaulting the informant's son Rupesh Sharma. Sanju Devi, the daughter-in-law of the informant was also assaulted with rod and lathi by the petitioner, thereafter all accused assaulted the son of the informant. It is also alleged that the petitioner resorted to fire with intention to kill the son of the informant but the firing did not hit him.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.37708 of 2015 (2) dt.17-09-2015 2/2 petitioner that the accusation of assault has been levelled against two persons when no injury has been found on the person of Sanju Devi, the daughter-in-law of the informant. One injury has been found on the head of the son of the informant. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Hulasganj P.S. Case No. 06 of 2015 pending in the court of learned Chief Judicial Magistrate, Jehanabad.

With the aforesaid observation, this application is disposed of.
