The petitioner seeks bail in a case registered under Sections 394, 412 of the Indian Penal Code.

Allegation is that the accused persons had taken cash of Rs.17,000/- and one mobile from the pocket of the informant. It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.05.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. Rs.4500/- is alleged to have been recovered from the petitioner along with one samsung mobile. Same is claimed by the petitioner. The petitioner has been made accused due to mistake of fact. No looted article is alleged to have been recovered from the

Patna High Court CR. MISC. No.50398 of 2019(2) dt.14-08-2019 2/2 possession of the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur in connection with Industrial P.S. case No.63 of 2019.
