JUSTICE PRABHAT KUMAR JHA ORAL ORDER 30-08-2019 Heard learned counsel for the petitioner, learned counsel for the complainant and learned APP for the State. The petitioner apprehends his arrest in Complaint Case No.681 of 2018 for the offences allegedly committed by the petitioner under Sections 498A and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner was granted provisional bail by order dated 02.05.2019 but the petitioner did not keep his wife. The petitioner appeared in Court on 02.07.2019. The complainant (wife of the petitioner) also appeared and on 02.07.2019 the petitioner was not agree to keep his wife and consequently the

Patna High Court CR. MISC. No.54501 of 2019(2) dt.30-08-2019 2/2 prayer for bail of the petitioner was rejected. It appears that in spite of several adjournments and much persuasion, the petitioner did not agree to keep his wife without any rhyme and reason and on such consideration his prayer for anticipatory bail was rejected by learned Additional Sessions Judge.

Having considered the facts aforesaid and the nature of allegations made against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
