====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 29-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 498, 354, 493 and 376/511 of the Indian Penal Code.
Allegation against the petitioner is of trying to establish physical relationship with the informant.
It has been submitted on behalf of the petitioner that he has no criminal antecedent. As per allegation son of petitioner happens to be the second husband of the informant. Subsequently, son of the informant decided to live separate from the informant and for the said reason petitioner has been roped in the present case. Informant is a lady of easy virtue and she has got the present case filed only for the purpose of blackmailing the petitioner and his family members.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the
Patna High Court Cr.Misc. No.39526 of 2015 (2) dt.29-09-2015 2 / 2 above named petitioner, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with K. Hat P.S. Case no. 176 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) sudip/- U T
