The petitioner seeks bail in a case registered under Sections 379, 411/34 of the Indian Penal Code. Allegation is that the petitioner had stolen Rs.83,000/- from the motorcycle of the informant and same was recovered. It has been submitted on behalf of the petitioner that the petitioner is in custody since 8.5.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is a labourer, who was working under the informant. The informant happens to be a contractor. The petitioner had demanded his wages as the wife

Patna High Court CR. MISC. No.51083 of 2019(2) dt.17-08-2019 2/2 of the petitioner had fallen ill. Wages of the petitioner was not being paid by the informant. Hence for oblique reason the present case has been instituted by the informant against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Rupouli P.S. case No.44 of 2019.
