The petitioner apprehends his arrest in Phulparas P.S. Case No. 18/2016 G.R. No. 87/2016, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code.

The informant named fifteen persons and alleged that they all having armed with different weapons came to his darwaja and began to assault him and others. Ajit Kumar Jha is said to have thrown a stone causing fracture in the leg of the informant. Ram Naresh Yadav (petitioner) is said to have given blow with Farsa and the said blow hit Buchia Devi. Buchia Devi got injury on her head.

Learned counsel for the petitioner submits that Buchia

Patna High Court Cr.Misc. No.30133 of 2016 (2) dt.09-09-2016 2/2 Devi got simple injury caused by hard and blunt substance. The occurrence took place due to land dispute and all the fifteen family members have falsely been implicated in this case. From the perusal of injury report it appears that Buchia Devi got scratch injury on left side of her forehead which is superficial and simple in nature. Petitioner is not alleged to have assaulted the informant.

Considering the facts aforesaid and the fact that there is land dispute between the parties, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Jhanjharpur (Madhubani) in connection with Phulparas P.S. Case No. 18/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
