The petitioner has prayed for bail in a case registered for the offence punishable under sections 302, 120B, 364/34 of the Indian Penal Code.

As per allegation in the FIR, five named accused persons were sitting outside the house of the informant and called her son by phone and took away him. When he did not return, informant suspects that her son was killed by the accused persons. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He is not named in the FIR. His name came in picture on the basis of restatement of the informant. He has not been put on TIP. No one

Patna High Court CR. MISC. No.53704 of 2022(4) dt.14-03-2023 2/2 is eye witness of the occurrence. Except suspicion, nothing has come against the petitioner during investigation. Petitioner is in custody since 12.07.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Begusarai in connection with Teghra P.S.
