Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504, 34 of the Indian Penal Code. The accusation against the petitioner is of assaulting the wife of the informant on her head by means of iron rod.
It is submitted by learned counsel for the petitioner that opinion has been reserved with regard to the injuries of the wife of the informant and there is no accusation of repeating the blow.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of regular bail, if the petitioner surrenders within
Patna High Court Cr.Misc. No.36142 of 2015 (2) dt.08-09-2015 2/2 a period of six weeks in connection with Manjha Garh P.S. Case No. 73 of 2015, pending in the Court of learned Chief Judicial Magistrate, Gopalganj.
With the observations above, the application stands disposed off.
