The petitioners seek bail in Haspura P.S. case No. 211 of 2018 registered under Section 30(a), 30(b) of Bihar Prohibition & Excise Act, 2016.

The police raided a hut from where 60 liters of spirit, wrapper, gas cylinder etc. were recovered.

The learned counsel for the petitioners submits that petitioners are not the owner of hut. They were passing through the road and the police apprehended both the petitioners and implicated in this case. The petitioners are in custody since 04.10.2018.

Considering the facts aforesaid and nature of allegation made against the petitioners and the fact that

No.75257 of 2018(2) dt.18-12-2018 2/2 petitioners have no criminal antecedent and they are in custody since 04.10.2018, the petitioners, above named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the lime amount each to the satisfaction of learned Additional Sessions JudgeVII-cum-Special Judge, Excise Act, Aurangabad in connection with Haspura P.S. case No. 211 of 2018.
