2. The petitioner is seeking regular bail in connection with Andhramath P.S. Case No. 111 of 2024 for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Amendment Act, 2022

3. The prosecution case, in short is that the informant along with police personnel, during vehicle checking, the accused persons tried to flee away after seeing the police party, but he was apprehended. On search, 324 liters of Nepali liquor was recovered from motorcycle of the petitioner.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.57652 of 2024(2) dt.27-08-2024 2/2 this case. He has further submitted that nothing was recovered from the possession of the petitioner. The petitioner is a person of clean antecedent and is under custody since 29.06.2024.

5. On the other hand, the learned APP has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances coupled with the fact that in huge quantity, liquor was recovered from possession of the petitioner, the petitioner above-named is directed to furnish bail bond after completion of custody for four months and on doing so, the court below shall release the petitioner on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Act, Jhanjharpur, Madhubani in connection with Andhramath P.S. Case No. 111 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
