The petitioner apprehends his arrest in connection with Warisaliganj P.S. Case No.100 of 2019 registered under Sections 30(a)(c)(d) of the Bihar Prohibition Excise Act. The accusation is that on receiving secret information about preparation of country made liquor by Kanhai Kumar, Bittu Kumar (petitioner), Ashok Singh, Sonu Kumar and Tuntun Kumar near western side of Durga Brick Kiln at village-Koanchgaon, the informant along with other police personnel reached there. On getting the information about arrival of the police, 6-7 persons started to flee away. While they were chased but they succeeded to flee away. On search, one Jerkin, containing 30 liters country made liquor, one gallon, containing 20 liters country made liquor,

The local people disclosed the name of the persons, who succeeded to flee away, including the name of the petitioner. Learned counsel for the petitioner submits that the petitioner was not apprehended on the spot rather the local people disclosed the name of the petitioner and others, who succeed to flee away from the place of the occurrence from where the alleged recovery is said to be made. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Nawada, in connection with Warisaliganj P.S. Case No.100 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
