JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-02-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 379 of the Indian Penal Code.

As per the prosecution case, this petitioner along with two other accused persons were apprehended with stolen motor cycle of the informant.

Learned counsel appearing for the petitioner submits that stolen motor cycle has not been recovered from the possession of this petitioner and name of this petitioner has been dragged in this case only on suspicion. Petitioner is in custody since 19.12.2020 and investigation in this case is complete. Other similarly situated co-accused have already been allowed bail by this Court vide orders passed in Cr.Misc.No. 49271/2021

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM, Patna in connection with Digha PS case No. 585/2020.
