JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 31-01-2023 The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month. Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Barh P.S. Case No. 187 of 2022, registered for the offences punishable under Sections 341, 354, 354A, 504 and 506 of the Indian Penal Code.

The allegation against the petitioner is that he misbehaved and outraged the modesty of the informant, when she was learning dance in the school, run by the petitioner. The learned counsel for the petitioner has submitted that, as a matter of fact, there was some dues of of fee against the informant and when he demanded, he was implicated in a false case. He has submitted further that a case under Section 366A of

Patna High Court CR. MISC. No.53675 of 2022(2) dt.31-01-2023 2/2 the Indian Penal Code was pending, but the petitioner has solemnized marriage with that girl and in that case, final form was not submitted.

On the other hand, the learned APP has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I Barh, Patna in connection with Barh P.S. Case No. 187 of 2022, subject to condition as laid down under section 438(2) Cr. P.C.

If the petitioner is found implicated in any other case of the similar nature, the learned court below shall be at liberty to cancel his bail bonds.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
