The petitioner apprehends his arrest in connection with Kasim Bazar P.S. Case No. 20 of 2016 registered under Section 307/34 of the Indian Penal Code and Section 27 of the Arms Act. The accusation of informant is that, on 17.02.2016, he went to attend a meeting at about 8.30 PM and on returning from Sandalpur arrived near the Tower then co-accused, Badal Kumar Yadav @ Badal Yadav along with the petitioner and others fired at him with intention to cause death but informant save himself on account of counter firing with his licensee arm. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case mere on
Patna High Court Cr.Misc. No.31998 of 2016 (3) dt.24-08-2016 suspicion. It is further submitted that similarly situated coaccused, Badal Kumar Yadav @ Badal Yadav, has already been granted privilege of anticipatory bail by a Bench of this Court vide order dated 27.06.2016 passed in Criminal Misc. No. 17978 of 2016.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-I, Munger, in connection with Kasim Bazar P.S. Case No. 20 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
