2. The petitioner seeks regular bail in connection with Naya Ram Nagar P.S. Case No. 48 of 2018 registered for the offence under Section(s) 364, 302, 201, 379, 411/34 of the Indian Penal Code.
3. As per the prosecution case, unknown criminals took away the truck along with Khalasi, who was sleeping in the truck of the informant and later on, dead body of the Khalasi was recovered.
4. Learned Senior counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. Petitioner is in custody since 24.04.2025. He further
Patna High Court CR. MISC. No.53748 of 2025(4) dt.04-11-2025 2/3 submits that during the investigation it has come that the petitioner was to purchase the truck in question. He has not been found involved in the crime. He further submits that the similarly situated co-accused have been granted bail by coordinate Bench of this Court vide Cr. Misc. No. 52325 of 2018 dated 26.10.2018 and Cr. Misc. No. 53002 of 2018 dated 27.09.2018.
5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.
6. Considering the facts and circumstances as well as the fact that similarly situated co-accused have been granted bail by a co-ordinate Bench of this Court, this application for regular bail is allowed.
7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 4th Additional Sessions Judge, Munger/concerned Court below in connection with Naya Ram Nagar P.S. Case No. 48 of 2018 subject to conditions that:- (i). The petitioner will mark his attendance at the Chakai Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the

(ii) The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bond of the petitioner.
(iii). The bailors will be close blood relatives of the petitioner.
