2. The petitioners seek bail in connection with Hasanganj P.S. Case No. 36 of 2025 dated 05.04.2025, instituted for the offence punishable under Sections 303(2), 317(2) of the B.N.S., 2023.

3. The prosecution case, in short, is that pump sets of the informant and one Jubel Marandi were stolen from their fields. On 04.04.2025, the villagers spotted two suspicious individuals carrying two pump sets on a motorcycle and chased them. The individuals namely, Suraj Choudhary and Shubham Kumar were caught and they confessed about the crime. They

Patna High Court CR. MISC. No.52447 of 2025(2) dt.11-08-2025 2/3 revealed the involvement of three other persons namely, Ramesh Kumar (petitioner no. 1), Abhishek Kumar (petitioner no. 2) and Anand Parihar in the said incident.

4. Learned counsel for the petitioners submits that the petitioners are innocent and they have been falsely implicated in this case. It is further submitted that petitioners have been made accused in this case only on the basis of disclosure made by the apprehended persons. Petitioners were not apprehended at the spot. Nothing has been recovered either from the conscious possession or from the house of the petitioners. It is further stated that co-accused, Shubham Kumar has been granted bail vide order dated 29.07.2025 passed in Criminal Miscellaneous No. 46305 of 2025. Lastly, it has been submitted that the petitioners are in custody since 06.04.2025, they have no criminal antecedents and charge-sheet has been submitted in the case.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like
